SPECIAL TOWN BOARD MEETING
January 24, 2012

Rezoning Petitions & Conditional Use Permits Applications
1. Call to Order: The Special Town Board Meeting of the Town of Lowell was called to order by Chairman John Schmitt at 9:16 p.m.
2. Board Members present:

Clerk Theresa Firari, _x_
3. The Meeting was acknowledged as posted by the Clerk according to State Statutes.
4. The Agenda was adopted by Huebner and seconded by Caine.
5. Public Input: None
6. DISCUSSION & MOTIONS:
The Rezoning Petition and Conditional Use Permit Application for Dean and Julie Wahl, Property Owners, was reviewed: to apply the RC-1: Rural Residential Overlay Zoning District and create a nonfarm residential lot from an 84.3 +/- acre tract located at W9628 Fairwood Road, Reeseville, in the NW ¼ of the SW 1/4 and parts of the NE ¼ of the SW ¼ and the SW ¼ of the SW ¼ of Section 5, and, part of the NW ¼ of the NW ¼ of Section 8, Town of Lowell, Dodge County, Wisconsin, (Parcel ID #032-101400533-002 & #032-1014-0532-001).
A motion was made by Huebner and seconded by Caine to pass Ordinance 2012-1, approving the RC-1 zoning and land division subject to two conditions:
(1) revise the CSM so that the approx. 50’ wide by 400’ long band of land east of the driveway over to the property line be included in the area of lot 1; and
(2) a deed restriction be placed on the remaining land that indicates said land has one remaining development right.
Motion carried. Voice vote: 3 yes, 0 no.
The Rezoning Petition and Conditional Use Permit Application for Frieda Kern, Property Owner, to apply the RC-1: Rural Residential Overlay Zoning District and create a non-farm residential lot from a 40.5 +/- acre tract located at N5160 York Road, in part of the SW ¼ of the NE ¼ of Section 32, T11N, R14E, Town of Lowell, Dodge County, WI (Parcel ID #032-1114-3213-000) was tabled. Motion by Caine, seconded by Huebner. Motion carried.
Motion by Huebner, seconded by Caine to adjourn the Special Meeting at 9:28 p.m. Motion carried.
